Kelly M. McQueen
has over fifteen years of experience in environmental and natural
resource law, having practiced in both the public and private
legal arenas. A former Assistant Attorney General for the State of
Arkansas in the Environment Section, Ms. McQueen is a 1991
graduate of Rhodes College in Memphis, Tennessee, where she
obtained a B.A. in Business and Economics. Having served as
Associate Managing Editor of the Law Journal and a charter member
of the Environmental Law Society, she received her J.D. with
honors in 1995 from the University of Arkansas at Little Rock,
William H. Bowen School of Law. The only person from Arkansas to
attend the prestigious environmental law program at Northwestern
School of Law at Lewis and Clark College in Portland, Oregon, Ms.
McQueen received her Masters of Law (LL.M) in environmental and
natural resources law from Lewis & Clark in 1997.
Ms. McQueen is admitted to the bar in Arkansas, Colorado, US District Courts for the Eastern and Western Districts of Arkansas, and US Courts of Appeal for the Eighth and Federal Circuits. She focuses her practice on environmental
and energy law, including federal and state environmental litigation; transactional and regulatory matters, including air, water and climate change issues;
federal and state multi-media permitting and enforcement,
including permits involving the Clean Air Act, Clean Water Act,
and waste management statutes; and due diligence. Her practice has particular emphasis on power plant and industrial facility siting
as well as Clean Air Act planning, permitting, and compliance,
including providing strategic legal advice to clients on such
issues as Clean Air Act non-attainment designations, carbon
dioxide regulation, operating permits, new source review, ozone
and fine particle programs.
Ms. McQueen often represents clients in dealing
with state and federal administrative agencies, including the US
Environmental Protection Agency, Arkansas Department of
Environmental Quality, Arkansas Natural Resources Commission, and
US Army Corps of Engineers, among others.
Representative clients and facilities for whom Ms. McQueen has rendered environmental counsel include multi-state power companies;
merchant power companies; industrial parks; municipalities and
local governments; petroleum marketers/distributors/bulk storage plants; chemical distributors/bulk storage plants; UST owners/operators, medical waste incinerators; resource recycling operations; solid waste recycling and disposal facilities; hazardous waste combusting cement kilns and incinerators; pulp and paper, specialty chemical, and other manufacturers; large scale real estate developers; quarry operations; hospitals; and bakeries.
The past Chair of the Arkansas Bar
Association Environmental Law Section, Ms. McQueen is the author
of several articles and publications on environmental law,
including Editor for the Lex Mundi Environmental Law World Desk
Reference. She is a member of the American, Arkansas, and Pulaski
County Bar Associations as well as the Arkansas Environmental
Federation, the Arkansas Chamber of Commerce, and the Arkansas Forestry Association.
